Cancelled Your Flat Purchase After Registration? How to Claim Back the Stamp Duty in Maharashtra

If a registered agreement for sale is cancelled, the stamp duty can be refunded, but time limits apply. What recent Supreme Court and Bombay High Court rulings say.

Under-construction residential projects in South Mumbai

On a Mumbai flat, stamp duty runs into lakhs. When a builder fails to deliver and the deal is cancelled, buyers often assume that money is gone. It can be refunded, but the paperwork and the deadlines matter.

The basic route

  • The agreement for sale must be cancelled through a registered deed of cancellation.
  • You then apply to the stamp authorities for a refund.
  • The Maharashtra Stamp Act sets time limits. In its current form, the State argues the refund application must be made within six months of registering the cancellation deed.
A cancelled deal does not have to mean lost stamp duty. Missed deadlines usually do.

What the courts have said

  • Harshit Harish Jain v. State of Maharashtra (Supreme Court, 24 January 2025): the buyer's cancellation deed was executed before an April 2015 amendment shortened the limit from two years to six months, so the older, longer period applied. The Court ordered a refund with 6% interest.
  • Katmandu Apparel v. IGR (Bombay High Court, 4 September 2025): stamp duty of Rs 25,64,120 had been paid in 2013. The cancellation deed came only in December 2022 after a long RERA fight and settlement. The authority rejected the refund as late. The High Court ordered the refund with 6% interest, holding that the buyer could not have applied earlier.

What to do

  • Insist on a registered cancellation deed as part of any settlement with the builder.
  • Apply for the refund immediately after registering it.
  • Keep the record of your RERA case or dispute. It explains any delay.
  • A refund is not automatic. You may need a lawyer if the authority refuses.
