Rent paid to a Non-Resident Indian (NRI) is subject to TDS at 31.2% (30% plus surcharge and 4% cess) under Section 195 of the Income Tax Act. There is no minimum threshold, and the tenant must hold a TAN and file Form 27Q each quarter.
Rent paid to a resident Indian for land or building attracts TDS at 10% under Section 194-I, applicable when the rent exceeds ₹50,000 per month. If the landlord has not furnished a valid PAN, TDS is deducted at 20% under Section 206AA.
A landlord can apply to the Assessing Officer for a Lower or Nil TDS deduction certificate under Section 197. Once issued, the landlord must share the certificate with the tenant, who then deducts TDS at the reduced rate stated on the certificate instead of the standard rate.
