Your Society Is Going for Redevelopment: A Member's Checklist for Mumbai

Hundreds of Mumbai societies have signed redevelopment deals since 2020. Before you vote or sign, check carpet area, rent, corpus, timelines and safeguards.

Redevelopment is reshaping Mumbai's older neighbourhoods. A Knight Frank India analysis reported in September 2025 counted 910 housing societies that had signed development agreements since 2020, unlocking about 326.8 acres and an estimated 44,277 new homes.

For members, redevelopment is the biggest financial decision their society will make. It is also a decision you share with your neighbours, so it pays to know what to look for before the general body votes.

The questions that matter most

QuestionWhy it matters
How much extra carpet area will I get, in RERA carpet terms?Offers quoted in built-up or super built-up area can look bigger than they are.
What monthly rent will the developer pay, and for how long? You'll need to rent elsewhere until possession. Check escalation and what happens if the project runs late.
Is there a corpus or hardship payment?Get the amount, timing and conditions in writing.
What is the completion timeline, and what is the penalty for delay?Rent should continue until possession, not until a fixed date.
Is there a bank guarantee or other security?Protects members if the developer can't finish.
Who pays stamp duty, registration and GST on members' new flats? These costs can be large. They should be spelt out.
Is the developer's track record verifiable?Check completed projects and any MahaRERA complaints.

Process safeguards to insist on

  • An independent project management consultant (PMC) appointed by the society, not by the developer.
  • Tendering and comparison of more than one offer.
  • General body approval with proper notice and minutes.
  • A lawyer for the society to review the development agreement and power of attorney.
  • Title and conveyance in order. If the society doesn't own the land yet, see deemed conveyance.

If your flat is rented out

  • Give your tenant notice in line with your leave and licence agreement once the vacating date is fixed.
  • Plan for the deposit refund and a move-out inspection.
  • Ask your CA how rent and hardship payments from the developer will be treated for tax. Tribunal rulings in Mumbai have treated such payments as capital receipts in specific cases, but your facts matter.

If you're an NRI member

You'll need a power of attorney or authorised representative for meetings and signing. Make sure every document you sign has been reviewed, and keep copies of the development agreement and your permanent alternate accommodation agreement.
