Is Your Building Going for Redevelopment? The New 2026 Rules Every Mumbai Society Member Should Read

Maharashtra's September 2026 GR changes society redevelopment rules: 51% consent, secret ballots, open tenders and member approval of the agreement.

Redevelopment is one of the biggest decisions a Mumbai family ever makes, and very often it's made in a crowded society hall on a Sunday morning, with half the members unsure what they're voting on. If you live abroad, you may not even be in the room.

On 30 September 2026, Maharashtra issued a new government resolution (GR) on how housing societies choose and agree redevelopment. It replaces the 2019 rules. Here's what it changes and why I think it's broadly good news for members.

What does the new 2026 redevelopment GR say?

Based on a summary by the law firm S&R Associates, the key points are:

  • Quorum and consent. The meeting needs a quorum of two-thirds of members, and at least 51% of all members must consent to redevelopment. At least 51% must attend physically, and members joining by video conference count towards quorum and voting.
  • Choosing the developer. The same thresholds apply. If one-fifth of members ask in writing, the vote is by secret ballot instead of a show of hands.
  • Open tender. The draft tender must be approved at the general body meeting and advertised in leading Marathi and English newspapers. If fewer than three bids come in, the first extension is now 15 days.
  • Project report. It must cover FSI and TDR, the applicable development rules, and a scheme-by-scheme comparison of benefits.
  • Bank guarantee. The general body decides the size and form of the developer's bank guarantee, instead of a fixed 20%.
  • Development agreement. It must now be approved by the general body, not just the managing committee.
  • Timelines. Individual permanent alternate accommodation agreements must be signed within three months of registering the development agreement.
In redevelopment, the most important vote is the one you understand before you raise your hand.

What this means for you

If you're an NRI member

The video-conference provision is a real step forward. You no longer have to fly in or rely entirely on a relative to vote for you. Ask your society secretary how they'll run virtual attendance, and ask for the project report and tender documents well before the meeting. Members are entitled to inspect them for free.

If you're on the fence about redevelopment

Read the project report properly. Compare carpet area offered, rent during construction, the corpus, the timeline and the bank guarantee. A secret ballot means you can vote honestly, without pressure from neighbours.

If you're renting out a flat in a building heading for redevelopment

Plan your tenant's notice early, and make sure your leave and licence agreement allows for it. Our guide to leave and licence agreements covers notice and lock-in clauses.
