How to File a MahaRERA Complaint Against Your Builder: Step by Step

Fees, forms, documents, conciliation, the 60-day target and appeals. A practical guide to taking a builder to MahaRERA over delay, refund or defects.

Coastal road leading into South Mumbai

Delayed possession, a refund that never comes, defects in a new flat: MahaRERA is the forum for all of these. Here is how the process works.

Which forum

  • Refund, interest or possession: the RERA Authority (section 31).
  • Compensation: the Adjudicating Officer (section 71).

MahaRERA uses a combined complaint form, and the portal routes the case based on what you ask for.

Fees and limitation

  • Rs 5,000 for an Authority complaint and Rs 5,000 for a complaint before the Adjudicating Officer. Check the portal for the current fee.
  • File within three years of the cause of action.
Most buyers win or lose a RERA case on their paperwork. Organise it before you file.

Steps

  1. Register on the MahaRERA portal and choose the complaint form.
  2. Fill in the complaint and upload documents.
  3. Pay the fee and note your complaint number.
  4. Before the hearing, file a short "convenience" set of key documents (MahaRERA caps it at 20 pages) at least a week ahead.

Conciliation

MahaRERA runs a voluntary conciliation forum where two conciliators help both sides settle. A registered settlement is enforceable like an order. If it fails, the case goes to hearing.

Timelines and appeals

  • The law targets disposal within 60 days of admission, though real cases often take longer.
  • Appeal to the Real Estate Appellate Tribunal within 60 days of the order. A builder appealing a refund or interest order must first deposit the awarded amount.

After an order: how to enforce it if the builder does not pay. Also read delay interest under section 18.
