Many buyers tell me the hardest part of a RERA case is not winning. It is getting paid. A builder ordered to refund money or pay delay interest sometimes simply does not pay. MahaRERA has a set procedure for this, laid out in its Circular 51/2025 of 18 November 2025.

When can you enforce?

A MahaRERA order becomes final and enforceable 60 days after the party receives it. If the builder has not paid by then, you file an execution application.

An order is only paper until it is executed. The execution route exists. Use it.

The enforcement steps

  1. File a non-compliance (execution) application online, seeking the refund, interest or compensation awarded.
  2. Listing: the application is to be listed within about four weeks. If non-compliance is clear, MahaRERA directs the builder to pay within a set time.
  3. Asset disclosure: if the builder still does not comply, it can be ordered to file an affidavit listing its properties, bank accounts and investments.
  4. Examination: if no affidavit is filed, the builder can be called for examination and to produce documents.
  5. Recovery: MahaRERA can impose a penalty and issue a recovery warrant to the Collector. Under section 40(1) of RERA, unpaid amounts are recoverable as arrears of land revenue, which allows attachment and auction of the builder's assets, including bank accounts.
  6. Civil court: under section 40(2), the matter can also go to the civil court for execution.

Practical tips

  • Keep the order, proof of service and your payment records in one file.
  • Calculate interest exactly as the order states, from the dates it states.
  • If the builder appeals, check whether it made the deposit the appeal requires before assuming payment is on hold.
