Why Do Mumbai Rent Agreements Run 11 Months? The Myth and the Rules

In Maharashtra, leave and licence agreements must be registered whatever their length, so the 11-month trick does not avoid registration. How to choose the right term.

Apartments in Powai

Ask anyone in Mumbai how long a rent agreement should be and they will say 11 months. Elsewhere in India, 11 months is used to avoid compulsory registration of leases of a year or more. In Maharashtra, that logic does not apply to leave and licence agreements.

The rule in Maharashtra

  • Section 55 of the Maharashtra Rent Control Act requires leave and licence agreements to be in writing and registered, regardless of term.
  • The landlord is responsible. Failing to register can attract up to three months' imprisonment, a fine of up to Rs 5,000, or both.
In Maharashtra, an 11-month agreement still has to be registered. Pick the term that suits you, not the myth.

So how long should yours be?

  • 11 or 12 months: flexibility to reset rent and terms each year, but you pay stamp duty, registration and police intimation each time.
  • 24 to 36 months: fewer renewals and a steadier tenant. Build in an agreed yearly increase and a lock-in.
  • Stamp duty grows with the term and the deposit. See how it is calculated.

Clauses that matter more than the term

  • Lock-in period and notice period.
  • Rent increase on renewal.
  • Who pays maintenance, property tax and repairs.
  • TDS terms if the owner is an NRI.
