Rent Renewal in Mumbai: How Owners and Tenants Can Agree a Fair Increase

Most Mumbai leave and licence agreements run 11 months, so renewals come round fast. How to set a fair increase, when to start talking, and what to put in writing.

Most residential leave and licence agreements in Mumbai run for 11 months, so rent renewal comes up almost every year. Handled early, it's a short conversation. Handled late, it can end with a vacant flat or a tenant scrambling to move.

Start 60 days before expiry

Two months gives both sides time to agree terms, register a fresh agreement and, if needed, plan a move. For flats we manage, our system flags agreements due in the next 60 days for exactly this reason.

How to decide a fair number

  • Check what similar flats are actually renting for in the same building or lane, not just asking rents on portals.
  • Look at the escalation clause in the current agreement, if there is one. Many agreements specify the increase at renewal.
  • Weigh the cost of vacancy. A month or two empty, plus brokerage and painting, can wipe out a year's increase.
  • Consider the tenant's record. On-time rent, good upkeep and no society complaints are worth something.
A reliable tenant at a fair rent is usually worth more than a higher rent and two months of vacancy.

For owners

  1. Raise the subject early, in writing.
  2. Back your number with comparable rents.
  3. Be clear about any repairs or upgrades you'll do at renewal.
  4. Register the new agreement. Don't rely on an informal extension.

For tenants

  1. Ask for the renewal terms well before expiry.
  2. Bring evidence: comparable rents and your payment record.
  3. Negotiate repairs or a longer term instead of only the rent figure.
  4. Read the new agreement carefully before signing, including the lock-in and notice period.

Don't forget TDS and records

If rent crosses tax thresholds or the owner is an NRI, TDS rules may apply to the tenant. See TDS on rent above Rs 50,000 and TDS on rent to an NRI landlord.
