A resident can gift a flat or office to an NRI or OCI relative under FEMA, and gifts from relatives are tax-free. Farmland is different, and stamp duty still applies.

Parents in Mumbai often want to put a flat in the name of a child who lives abroad. It can be done, but two sets of rules apply: FEMA (can the NRI receive it?) and income tax (is the gift taxed?).
A gift between close relatives is usually tax-free. The paperwork still has to be right.
A gift deed must be stamped and registered. Maharashtra has a concessional duty for gifts of residential property to close family. See gift deed stamp duty in Maharashtra.
Yes. Under FEMA, an NRI or OCI can receive immovable property other than agricultural land, plantation property or a farmhouse as a gift from a person resident in India.
Gifts from relatives, including parents, are exempt from income tax. Stamp duty on the gift deed still applies.
This is general information, not legal or tax advice. Rules change, so check your own case with a lawyer or CA.
