MahaRERA's Four-Month Force Majeure Extension: What It Means for Your Possession Date

Many Maharashtra projects got four extra months after the West Asia conflict was treated as force majeure. Which projects qualify, and what buyers keep.

New residential projects under construction in South Mumbai

If your under-construction flat's completion date on MahaRERA has quietly moved by four months, this is likely why. After a central government circular treated the West Asia conflict as a war-like situation, MahaRERA applied the force majeure provision of the RERA Act and extended completion dates for eligible projects.

The short version

  • A Ministry of Housing and Urban Affairs (MoHUA) circular dated 31 July 2026 treated the West Asia conflict as a war situation, a named force majeure event under RERA.
  • MahaRERA applied this under Section 6 of the RERA Act and moved completion dates forward by four months for eligible projects.
  • No application is needed. The extension applies once the portal is updated.
  • Your right to delay interest is not waived. It applies to delay beyond the four-month window.

Which projects qualify?

ConditionWhat it means
Completion date on or after 28 February 2026The original, revised or already-extended completion date must fall on or after this date.
Registered before 1 August 2026Projects registered on or after 1 August 2026 are excluded.
Not already overdueProjects that were already late before the window don't get relief for that earlier delay.

What buyers should do

  1. Check your project on MahaCRITI, MahaRERA's portal, for the current completion date. Don't rely on the developer's brochure or emails.
  2. Compare it with your agreement for sale. Note the possession date written there.
  3. Work out the real delay. If the developer misses even the extended date, the four months don't cover the extra delay.
  4. Keep records of all developer communication on timelines.
The extension moves the completion date. It does not cancel a buyer's right to interest for delay beyond it.

Can you still claim interest?

Yes, for delay outside the extension. Under Section 18 of the RERA Act, a buyer can claim interest for delay or seek a refund with interest. A developer who was already late before 28 February 2026 remains responsible for that earlier delay.

What if you rented a home while waiting?

Many buyers pay rent while their flat is under construction. Four more months of rent and EMI is a real cost. Factor it into any decision to stay invested or exit, and talk to a lawyer before filing a complaint.

NRI buyers

If you're abroad, check the MahaCRITI project page once a quarter and keep a copy of your agreement for sale handy. If possession is approaching, read our new flat possession checklist and how to take possession by letter of authority.

Frequently asked questions

Do I need to apply for the extension as a buyer?

No. It applies to eligible projects automatically. Buyers should check the updated date on the portal.

Does this cancel my delay compensation?

No. It only covers the four-month window. Delay beyond it, or before 28 February 2026 where the project was already late, is still the developer's responsibility.

Does it apply to new projects?

Projects registered on or after 1 August 2026 are excluded.
