Maharashtra's New Model Bye-Laws for Housing Societies: What Owners and Tenants Should Watch

Maharashtra plans one uniform set of model bye-laws for 1.25 lakh+ housing societies, replacing the 2014 version. What may change for owners and tenants.

Every cooperative housing society in Maharashtra runs on its bye-laws: the rulebook for maintenance, parking, tenants, transfers and meetings. Most societies use a version of the model bye-laws last revised in 2014. That is about to change.

What's happening

  • The state is preparing a single, uniform set of model bye-laws for more than 1.25 lakh registered housing societies.
  • A committee headed by a Deputy Registrar drafted them to align with the Maharashtra Co-operative Societies Act and the 2026 amendment rules.
  • Reports in August 2026 cited a target rollout of October 2026. The final text and notification date had not been published at the time of those reports.

Areas the new bye-laws are reported to cover

AreaWhy owners care
Maintenance charge calculationHow your monthly bill is worked out
Tenant and leave and licence documentationWhat the society can ask for when you rent out
Non-occupancy chargesWhat you pay when you don't live in the flat
Parking allotmentHow spaces are allotted and charged
Statutory audits and financial planningHow society money is managed and reported
Membership and share capitalWho can be a member and on what terms
Until your society adopts the new bye-laws at a general body meeting, the old ones still apply.

When do they apply to your society?

Model bye-laws don't apply automatically the day they're published. As with earlier revisions, societies generally adopt them through a general body resolution and register the amendment. Until then, your society's registered bye-laws continue to apply.

What owners should do now

  1. Watch for the official notification from the Co-operation Department before acting on any draft.
  2. Get a copy of your society's current registered bye-laws. You'll want to compare.
  3. Attend the general body meeting where adoption is discussed. If you're abroad, check how proxy or online participation works in your society.
  4. Review your tenant paperwork. If documentation rules change, your manager will need to update what is submitted to the society.

What tenants should know

Tenants aren't society members, but bye-laws decide what documents the society asks for at move-in and which common facilities tenants can use. Ask your landlord or manager what the society requires before you shift.

Earlier in 2026, Maharashtra also notified new housing society rules. Our post on Mumbai society rules 2026 covers non-occupancy charges and other changes.

Frequently asked questions

Do the new model bye-laws apply automatically?

Generally no. Societies adopt them by general body resolution. Check the final notification for the exact process.

Will they change my maintenance bill?

They're reported to cover how maintenance is calculated. Any change will depend on the final text and your society adopting it.
