How to transfer a Mumbai flat after an owner's death: probate for wills, succession papers without one, the society transfer, BMC records and what NRI heirs need.

Losing a parent is hard enough without a pile of paperwork. Yet a Mumbai flat left without its papers sorted becomes hard to rent, sell or redevelop. Here is the order in which things usually need to happen, so the family can take it one step at a time.
For a will dealing with immovable property in Mumbai, probate is generally mandatory. According to a Mansukhlal Hiralal & Co. guide on Mondaq (December 2025), without probate, housing societies and registration authorities generally refuse to transfer ownership. Probate is granted by the Bombay High Court or designated courts. A will doesn't have to be registered to be valid.
Inheritance then follows the succession law that applies to the family: the Hindu Succession Act for Hindus, Buddhists, Jains and Sikhs, Muslim personal law, or the Indian Succession Act for Christians and Parsis. The heirs establish their rights with a succession certificate or a legal heirship certificate.
One point many families miss: a succession certificate establishes entitlement, but it doesn't itself transfer title. If the heirs agree that one of them should own the flat, that's usually done through a registered release deed by the others.
The heirs, or the nominee, apply to the society for transfer of the share certificate and membership, typically with:
Society records are administrative. They are not proof of legal title on their own, which is why the probate or succession step matters.
Do the paperwork in order: court, then society, then BMC. Skipping a step only means coming back to it later.
Update the name on the BMC property tax account and the electricity connection after the society transfer. Mutation updates government records for tax purposes, but it doesn't create title. Our guide to BMC property tax explains the account.
Inheritance itself is not taxed. Rent from the inherited flat is taxable in the heir's hands, and when the flat is sold, capital gains are generally worked out using the original owner's cost.
The Mondaq guide notes that NRIs can inherit property in India without prior RBI approval if it was legally acquired, and can act through a power of attorney or representative. Repatriating sale proceeds later is subject to limits; see our post on repatriating flat sale proceeds.
While the legal process runs, an inherited flat still needs looking after: bills, society dues, inspections and, if the family decides, tenants. That's what our property management does, with every document in the TND app.

For a will dealing with immovable property in Mumbai, probate is generally mandatory, and societies and registration authorities usually require it before transferring ownership.
They establish their rights through a succession or legal heirship certificate, and title is usually consolidated through registered release deeds among the heirs.
Inheritance isn't taxed, but rent from the flat and any later sale are taxable.
