Mumbai deposits are set by agreement and can be large. What the agreement should say about deductions and refund timing, so move-out doesn't become a dispute.

The security deposit is the most common source of landlord-tenant disputes in Mumbai. Most disputes come from one thing: an agreement that doesn't say clearly what can be deducted and when the deposit comes back.
Deposit amounts in Mumbai are negotiated and set in the leave and licence agreement. They vary by area, rent level and whether the flat is furnished. The central Model Tenancy Act, 2021 suggests capping residential deposits at two months' rent, but it applies only where a state adopts it, so check the law that applies to your tenancy.
A clear move-in record is the best protection for both sides. Without it, every deduction becomes an argument.
| Issue | How to avoid a dispute |
|---|---|
| Painting | State in the agreement whether repainting is deducted, and on what basis |
| Broken fixtures | Photograph condition at move-in and move-out |
| Unpaid bills | Check final electricity and gas bills before refund |
| Missing rent records | Log every rent payment as it happens |
Our move-out and deposit refund checklist walks through the full process. For flats we manage, tenants log payments in the TND app, which makes settlement a calculation rather than an investigation.
Deposits are generally set by agreement. The Model Tenancy Act suggests a two-month cap, but only where a state has adopted it. Check the current law for your tenancy.
Normal wear is generally not tenant damage. Your agreement should say what can be deducted.
