Before Any Resale Paperwork Starts, We Put the Price and Our Fee in Writing

Why TND confirms the agreed sale price and the full service fee by email before resale paperwork starts on a Mumbai flat, from a live Kanjurmarg case.

I'm Ankita Chourasia from the operations team at TND Listings. Last week I sent a short email that I think every seller in Mumbai should receive before a single document is drafted. It confirmed, in writing, the sale price a seller had agreed for his flat in Kanjurmarg East, and asked him to acknowledge it.

He replied the same day, confirming the price and the total service fee, including the cost of the registration documents, with no hidden charges.

Why confirm the sale price by email?

Because resale deals in Mumbai move through many hands: buyer, seller, both agents, the bank, the society, sometimes a lawyer. A price agreed on a phone call can drift by the time the agreement is drafted. One email that both sides acknowledge becomes the reference point for everyone.

Why put the fee in writing too?

Brokerage disputes usually start at the end of a deal, when money is about to change hands. If the fee and what it covers are written down at the start, there's nothing to argue about at the end. In this case the seller himself wrote back that the fee included the registration documents and there would be no hidden charges.

If the price and the fee are written down at the start, there's nothing to argue about at the end.

What comes after the price is confirmed?

  • Society documents. We write to the society for what the buyer's side will need, such as a copy of the share certificate.
  • Title and old paperwork. Banks look closely at old agreements. In one Kandivali East resale on our Owners' Wall, the buyer's bank found an old agreement that had since been cancelled and paused the loan until we provided the cancellation papers.
  • One timeline. We keep buyer, seller and bank moving on the same dates.
  • TDS. If the seller is an NRI, TDS applies on the sale, so plan it early. Our NRI selling guide explains it.

Frequently asked questions

Is an email confirmation of the sale price legally binding?

It isn't the sale agreement, but it's a clear written record of what both sides agreed, which helps avoid disputes later.

What should a broker's fee include?

Ask for it in writing, with what it covers, such as registration paperwork, before you start.

What documents does a seller need for a Mumbai resale?

Ownership papers, the previous chain of agreements, the society share certificate and NOC, and ID and PAN for all owners.
