Running a Day-Care, Office or Clinic From a Residential Flat in Mumbai: Change of User Explained

In August 2026 the Bombay High Court gave a Powai day-care six weeks while MHADA decided on change of user. What owners and tenants should check first.

We sometimes get enquiries from tenants who want a residential flat for a small office, a tuition class or a day-care. It's an easy yes for the rent, but it can be a hard problem for the owner.

The Powai case, August 2026

  • A pre-school and day-care ran from four flats in a MHADA-built residential building in Powai.
  • MHADA issued notices in March and June 2026 to stop commercial activity, because no change of user from residential to commercial had been obtained.
  • Other members of the society objected that commercial use without permission is not allowed.
  • The Bombay High Court let the day-care continue for six weeks, in the interest of the children, and directed MHADA to decide the change of user applications within four weeks. Members could file objections. If change of user is refused, MHADA may act to close the activity.
  • In a related petition, the court noted MHADA could act against flats allegedly used as Airbnb-style rentals.

The lesson

Permission comes first. Applying after you've started puts you on the back foot with the authority and your neighbours.

A residential flat is approved for living in. Commercial use needs permission, and the neighbours can object.

What to check before allowing non-residential use

  1. Approved use. Check what the building's approvals and occupation certificate allow.
  2. Change of user. Find out which authority decides (BMC, MHADA or another planning authority) and what it requires.
  3. Society consent and bye-laws. Many societies restrict commercial use and charge for it.
  4. Your agreement. A leave and licence agreement should state the permitted use. Residential-use-only clauses protect owners.
  5. Insurance and safety. Day-cares and clinics bring footfall and fire-safety obligations.

For owners renting out

If a tenant asks to use your flat for business, say no until approvals are in place, or you risk notices addressed to you as owner.
