BMC Property Tax and the 2026 MMC Act Amendment: What Mumbai Owners Should Know

A 2026 amendment to the Mumbai Municipal Corporation Act validated BMC's capital value tax rules back to 2010. What it means for bills, refunds and disputes.

Mumbai's property tax is based on a property's capital value. Over the years, parts of BMC's capital value rules were challenged in court. In 2026, the state amended the Mumbai Municipal Corporation (MMC) Act to put the system on firmer legal footing.

What the 2026 amendment does

  • It was enacted as Maharashtra Act No. XXI of 2026. The Governor's assent was published on 15 April 2026, and the Act took effect that day.
  • It substitutes parts of Section 154 of the MMC Act, the section that governs capital value assessment, with effect deemed from 1 April 2010.
  • Assessment considers the user category, building type, age and area. Built-up area applies up to 31 March 2015, and carpet area from 1 April 2015.
  • BMC's 2010 and 2015 Capital Value Rules are deemed validly made from their respective dates.
  • Past tax and penalties are deemed validly levied. Suits seeking refunds on that ground are barred, though owners can still challenge assessments under the amended law and claim refunds of genuinely excess payments.

What this means for your bill

The amendment is about the legal basis of the tax, not a new rate. Your bill still depends on your flat's capital value, which is linked to ready reckoner rates and the factors above. BMC's 2025 revision of capital values, reported as an average increase of around 16%, followed updated ready reckoner rates. BMC stated that tax rates and structure did not change.

The amendment is about the legal basis of the tax, not a new rate. Check that your bill uses the right area and user category.

The 500 sq ft exemption

Residential flats up to 500 sq ft remain exempt from the general property tax component, under an exemption introduced in 2022. If your flat is that size and you've been billed, check your bill category.

What owners should do

  1. Read your bill carefully. Check the area (carpet area from 2015), user category and property account number.
  2. Pay on time. BMC has offered rebates for early payment in some years and charges penalties on arrears.
  3. Raise disputes through the proper channel. If you think the assessment is wrong, file an objection with BMC rather than withholding payment.
  4. Keep bills and receipts. Buyers and their banks ask for them at resale.

Frequently asked questions

Did the 2026 amendment raise property tax rates?

No. It validated the capital value system and rules. Your bill depends on your capital value and BMC's rates.

Can I still challenge my assessment?

Yes. The amendment bars refund suits that rely on the old rules being invalid, but owners can still challenge assessments under the amended law.
